These Terms & Conditions (“Terms”) apply to the use of GemStateTotes.com and to general requests for Gem State Totes LLC services. By using this website or submitting a service request, you agree to these Terms. A separate Rental Agreement may apply to an actual tote rental and governs customer-specific rental obligations.

1. Check Availability Requests

Submitting a Check Availability form, sending a message, calling, or texting Gem State Totes does not create a reservation and does not guarantee tote availability. All requests are subject to manual review of inventory, requested dates, quantity, service location, and scheduling availability.

2. Reservation Confirmation and Payment

After availability is verified, Gem State Totes may send a secure Square payment link by text or email. Unless Gem State Totes expressly agrees to another arrangement, a reservation is confirmed only after availability has been verified and required payment has been received. If payment is specifically arranged for delivery, payment must be completed before totes are unloaded.

3. Rental Packages and Pricing

Current standard advertised packages are:

A dolly is included with each rental package. Additional totes are $4 each. An additional 7-day rental period is $49 and is subject to availability. Prices, packages, promotions, and service offerings may be updated from time to time. The price confirmed for a customer’s reservation will control that reservation.

4. Local and Extended Service Areas

Free local delivery and pickup are offered in Nampa, Caldwell, Meridian, West Boise, Star, Eagle, and Kuna, subject to scheduling and service availability.

Middleton, Emmett, Melba, and East Boise are extended service areas and are subject to a $25 per visit service fee. A delivery and a pickup are separate visits. Therefore, a standard extended-area rental requiring one delivery and one pickup generally includes a $25 delivery fee and a $25 pickup fee.

Service-area availability may vary. Customers outside listed areas should contact Gem State Totes before submitting payment.

5. Sunday Service

Sunday delivery and pickup may be available by advance scheduling for $50 per Sunday visit. Sunday service must be requested in advance and is subject to availability. A Sunday delivery and a Sunday pickup are separate visits and each may carry the $50 Sunday service fee.

6. Rental Periods and Extensions

Standard rental periods are 7 days unless otherwise confirmed in writing by Gem State Totes. Customers requesting additional rental time should contact Gem State Totes before the scheduled pickup. Additional 7-day rental periods are $49 and are subject to availability. An extension is not guaranteed until approved by Gem State Totes. Keeping rental equipment beyond the confirmed rental period without approval may result in additional charges or other remedies permitted under the Rental Agreement or applicable law.

7. Rental Agreement

An actual tote rental may require acceptance or signature of a separate Gem State Totes Rental Agreement. The Rental Agreement may contain additional terms regarding delivery and pickup, possession and use of equipment, prohibited use, lost or damaged equipment, replacement charges, customer responsibilities, and other rental-specific matters. If there is a conflict between these website Terms and a signed or accepted Rental Agreement regarding an actual rental, the Rental Agreement controls for that rental.

8. Totes, Lids, Dolly, and Damage

Customers are responsible for rented equipment while it is in their possession, subject to the terms of the applicable Rental Agreement. Replacement charges may apply to lost or damaged equipment. Current listed replacement charges are $15 per tote and $8 per lid. Additional terms concerning the dolly or other equipment may be stated in the Rental Agreement.

Customers should not write directly on the totes. Blue painter’s tape is included with each rental for labeling and should be removed when the rental is complete.

9. Website Information

We make reasonable efforts to keep website information accurate and current. Website content is provided for general information and service-request purposes. Typographical errors, outdated information, or technical issues may occasionally occur. Gem State Totes may correct errors and update website content, pricing, policies, or service information. Any confirmed reservation terms communicated directly to the customer will control that reservation.

10. Acceptable Website Use

You may not misuse the website, attempt unauthorized access, interfere with website operation, submit knowingly false or fraudulent requests, or use the website in violation of applicable law.

11. Third-Party Services

The website or customer workflow may use third-party services, including website hosting, communications, social media, and Square payment services. Those services may be subject to separate terms and privacy notices. Gem State Totes is not responsible for third-party websites or services outside our control.

12. Disclaimer and Limitation of Liability

To the fullest extent permitted by applicable law, Gem State Totes is not liable for indirect, incidental, special, or consequential damages arising solely from use of, or inability to use, this website. Nothing in these Terms is intended to waive rights or responsibilities that cannot legally be waived or limited under applicable law. Rental-related rights and responsibilities may also be governed by the applicable Rental Agreement.

13. Governing Law

These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles. Any dispute will be handled in accordance with applicable law and any controlling terms of the applicable Rental Agreement.

14. Changes to These Terms

Gem State Totes may update these Terms from time to time. Updated Terms will be posted on this page with a revised “Last Updated” date. Changes apply prospectively unless otherwise required by law.
